If space law didn't exist I still do not think that the men would have been able to claim Mars because whichever country landed on Mars would probably attempt to claim it.

1. I could see tons of future space law cases happening, especially with constant improvements in technology. Not to far from now people will be attempting to drill into different planets, and collect comet pieces, and stuff.
